These Terms & Conditions ("Terms") govern your purchase and use of the eSIM data plans and related services (collectively, the "Service") provided by Sovrax LLC, a limited liability company registered in the State of Wyoming, United States, with its registered address at 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, USA ("Sovrax", "we", "us", or "our").
By placing an order, completing a purchase, or otherwise using the Service, you ("you" or "Customer") acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, please do not use the Service.
1. Definitions
- eSIM — an embedded SIM profile delivered digitally (typically as a QR code or activation code) that allows a compatible device to connect to a mobile network.
- Data Plan — a prepaid mobile data package with a defined data allowance, validity period, and country or regional coverage, purchased from Sovrax.
- Partner Network — a local or international mobile network operator whose infrastructure is used to deliver connectivity under a Data Plan.
- Activation — the moment the eSIM profile is installed on a device and first connects to a Partner Network, or the moment the validity period of the Data Plan otherwise begins, whichever occurs first.
2. The Service
Sovrax sells prepaid eSIM Data Plans for use in supported countries and regions. The Service provides mobile data connectivity through agreements with Partner Networks. Unless expressly stated in the Data Plan description, the Service does not include voice calls, SMS, MMS, tethering, or a phone number.
The Service is available worldwide to customers whose devices are eSIM-capable and carrier-unlocked, subject to local laws and the coverage footprint of the selected Data Plan.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract to purchase the Service. By purchasing, you represent that you meet these requirements and that the information you provide is accurate, current, and complete.
4. Device Compatibility
eSIM technology requires a compatible, carrier-unlocked device. It is your sole responsibility to verify before purchase that your device supports eSIM and is unlocked for use with foreign or alternative carriers. A current compatibility list is available on our website and is provided for guidance only; manufacturer specifications change and ultimate responsibility rests with the device owner.
Refunds will not be issued where a Data Plan cannot be used due to device incompatibility, carrier lock, outdated operating system, or regional device restrictions.
5. Orders, Pricing, and Payment
Prices are displayed at checkout in the currency indicated and are inclusive or exclusive of applicable taxes as noted at the point of sale. We reserve the right to correct pricing errors and to change prices at any time prior to your order being confirmed.
Payment is processed by third-party payment processors (including, but not limited to, Stripe). By submitting payment information, you authorize us and our processors to charge the payment method you provide for the total amount of your order. You represent that you are the authorized user of the payment method used.
An order is accepted only once you receive an order confirmation email from us. We may refuse or cancel any order, in whole or in part, where we reasonably suspect fraud, payment authorization issues, regulatory restrictions, or stock unavailability. If we cancel an order that has already been charged, we will issue a refund to the original payment method.
6. Delivery
The Service is a digital product. Following successful payment, the eSIM (QR code and/or activation details) is delivered to the email address provided at checkout and is also available in your Sovrax account. Delivery is normally immediate but may be delayed due to anti-fraud review or technical issues. If you have not received your eSIM within 30 minutes, please check your spam folder and contact support@360esim.com.
7. Activation, Validity, and Usage
Each Data Plan has a defined data allowance and validity period as described at the point of sale. The validity period begins on Activation. Unused data does not carry over after the validity period ends and is non-transferable and non-refundable once Activation has occurred.
Many Data Plans have an installation window (typically 30 days or as stated in the Plan description) within which the eSIM must be installed or it may expire. It is your responsibility to install and activate the eSIM within any stated window.
8. Coverage and Service Quality
Network coverage, signal strength, and data speeds are provided by Partner Networks and depend on factors outside our control, including your location, device, network congestion, weather, and Partner Network policies. Advertised speeds (e.g., 4G/LTE, 5G) represent the maximum theoretical speed available on the Partner Network and are not guaranteed.
Partner Networks may apply fair-use limits, throttling, or prioritization after certain data thresholds. Where applicable, these are described in the Data Plan details. Some services (e.g., VoIP, tethering, hotspotting) may be restricted or blocked by the Partner Network.
9. Fair Use and Prohibited Activities
You agree not to use the Service:
- for any unlawful purpose, or in violation of any applicable local, national, or international law;
- to transmit, host, or distribute infringing, harmful, defamatory, or obscene content;
- to send unsolicited commercial communications (spam), engage in phishing, or commit fraud;
- for machine-to-machine (M2M), IoT, permanent roaming, or commercial redistribution, unless explicitly permitted;
- to interfere with or disrupt the Service or Partner Networks; or
- to circumvent fair-use thresholds, throttling, or any technical limits applied by Partner Networks.
We may suspend or terminate the Service, without refund, where we reasonably believe you have breached this section. Where required by law, we may disclose usage information to law enforcement or regulatory authorities.
10. Taxes
You are responsible for any taxes, duties, or other governmental charges that may apply to your purchase outside those collected by us at checkout.
11. Refunds and Cancellations
Refunds are governed by our Refund Policy, which forms part of these Terms. Because the Service is a digital, prepaid product, refunds are limited and generally available only where the eSIM has not been Activated.
12. Intellectual Property
All content on our website and within the Service — including the Sovrax name, logo, text, graphics, software, and design — is owned by or licensed to Sovrax and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial use only.
13. Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to that processing.
14. Third-Party Services
The Service relies on third parties, including Partner Networks and payment processors. We are not responsible for the acts or omissions of third parties beyond our reasonable control, except to the extent required by applicable law.
15. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will be continuous, fault-free, or available in every location.
16. Limitation of Liability
To the maximum extent permitted by law, Sovrax's total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you for the specific Data Plan giving rise to the claim. In no event shall Sovrax be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of business, or loss of goodwill, even if advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
17. Indemnification
You agree to indemnify and hold harmless Sovrax, its officers, employees, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
18. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, where you materially breach these Terms, where required by law, or where necessary to protect the integrity of the Service. Termination does not entitle you to any refund beyond what is provided in our Refund Policy.
19. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a new effective date. Your continued use of the Service after the update constitutes acceptance of the revised Terms.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by binding arbitration administered in Sheridan County, Wyoming, except that either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.
You agree that any dispute will be brought on an individual basis only and not as part of a class, consolidated, or representative action. Where mandatory consumer-protection laws in your country of residence provide you with rights that cannot be waived, those rights continue to apply.
21. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them freely.
